Terms of Service

By accessing or using WitnessLens (the “Service”), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these terms. If you do not agree to these terms, do not use the Service.

WitnessLens is an expert witness intelligence platform that aggregates public records and AI-assisted analysis about patent expert witnesses, including PTAB Final Written Decision outcomes, Daubert and district court rulings, CVs, hourly rates, and representation history. The Service is provided on an “as available” basis with no guaranteed uptime.

All information made available through the Service is research data compiled from public sources and AI-assisted processing. It is preliminary background material intended solely to assist qualified legal professionals. Information should be independently verified before being relied upon for any legal decision. WitnessLens is not a law firm and does not establish an attorney-client relationship.

You agree not to use the Service or its output as the basis for any decision regarding consumer credit, insurance, employment, tenant screening, housing, or other purpose subject to the U.S. Fair Credit Reporting Act or similar consumer-reporting laws. The Service is not a consumer reporting agency and its output is not a consumer report.

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You must notify us promptly if you become aware of any unauthorized use of your account.

Access to the Service may require payment of a subscription or access fee, which will be communicated to you at the time of order. All purchases are final and non-refundable, except as required by applicable law or as expressly provided in these terms.

Subscriptions do not automatically renew. Each renewal is a separate purchase, and you will be notified of any pricing change before renewal.

You retain ownership of any data you submit to the Service, including saved searches, lists, notes, and case context. You grant us a limited, non-exclusive license to use, store, and process such data solely to provide and improve the Service. You warrant that any third-party content you enter into notes, case-context fields, or other free-form inputs is content you have the right to use for that purpose.

The expert witness profile data displayed by the Service is compiled from public records and is not your data.

We treat the searches, lists, notes, and case context you submit as confidential, and we share them only with third-party service providers who help us operate the Service or as required by law.

You agree not to:

• Use the Service for any unlawful purpose or in violation of these terms;
• Attempt to gain unauthorized access to any account, system, or data;
• Reverse engineer, decompile, or attempt to extract source code or models from the Service;
• Scrape, crawl, harvest, or systematically download data from the Service except as expressly permitted;
• Use the Service or its data, in whole or in part, to compile, train, or populate a competing dataset, model, or product;
• Resell, sublicense, or commercially redistribute Service data in bulk to third parties;
• Use the Service to harass, intimidate, dox, threaten, or otherwise misuse information about any individual identified within it;
• Manipulate billing, access controls, or rate limits;
• Share your account credentials with anyone outside your organization.

You may view, save, and export reports, lists, and other outputs generated for you by the Service for your internal professional use. Outputs remain subject to the disclaimers in Sections 3 and 11. You may not redistribute Service outputs as a substitute service or commercial dataset.

Futurist IP retains all rights, title, and interest in and to the Service, including all software, designs, datasets, models, and underlying technology. Nothing in these terms transfers ownership of the Service to you.

Information displayed by the Service is compiled from public records (including PTAB filings, federal and state court dockets, and publicly available CVs) and is processed using AI-assisted extraction and analysis. Both the underlying source records and the AI-generated output may contain errors, omissions, misattributions, or out-of-date entries.

The Service is a compilation of public records and computed analyses. WitnessLens does not warrant the accuracy of any source record and does not opine on the truthfulness of statements made within those records. You are solely responsible for reviewing and independently verifying any information before relying on it.

WitnessLens publishes profiles of expert witnesses compiled from public records. If you are an individual whose profile is displayed by the Service and you believe a profile has been misattributed to you, or that information shown about you is inaccurate, you may submit a correction request to contact@witnesslens.com.

We will acknowledge receipt within ten (10) business days and will investigate and respond within thirty (30) days. Where the underlying information is accurately drawn from a public record, we may decline removal, but we will correct misattributions and note any disputed entries.

You agree to indemnify and hold Futurist IP harmless from any claims, damages, or expenses arising from (a) your violation of these terms, (b) your reliance on Service output without independent review, or (c) your infringement of any third-party rights.

To the maximum extent permitted by law, in no event shall Futurist IP’s aggregate liability under these terms exceed the greater of (a) the fees you paid for the Service in the twelve months preceding the claim, or (b) one hundred dollars ($100 USD).

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including without limitation any warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

We may suspend or terminate your access to the Service at any time, with or without cause. If we terminate without cause, you will be entitled to a pro-rata refund of any prepaid access fees for the unused portion of your term. Suspensions or terminations for cause do not entitle you to a refund. You may export your data for at least 30 days following termination. You may terminate your account at any time by contacting us.

You may delete saved searches, lists, and other content you have created at any time. To request full account deletion, contact us at the email below. Following account deletion, we may retain limited transaction records for up to seven (7) years as described in Section 11 of the Privacy Policy.

Neither party will be liable for failures or delays caused by circumstances beyond its reasonable control, including network outages, infrastructure failures, natural disasters, war, or government action.

The Service is intended for users 18 years of age or older. By using the Service, you warrant that you are at least 18 years old.

The Service is intended for use by professionals located in Canada and the United States. We make no representation that the Service is appropriate or available for use in other jurisdictions, and those who access the Service from other jurisdictions do so on their own initiative and are responsible for compliance with local law.

You represent that you are not located in, under the control of, or a national or resident of any country subject to applicable U.S. or Canadian sanctions, and that you are not on any sanctioned-party list maintained by the U.S. Office of Foreign Assets Control (OFAC), Global Affairs Canada, or any equivalent authority.

We may update these Terms from time to time. We will provide at least 30 days’ advance notice of material updates by email or by posting a notice on the Service. Continued use after the effective date constitutes acceptance.

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute arising out of these Terms shall be subject to a 30-day good-faith negotiation period before any party commences proceedings, which shall be brought in the courts of Ontario, Canada.

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall remain in full effect.

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Futurist IP regarding the Service.

You may not assign your rights under these Terms without our prior written consent. We may assign our rights and obligations to an affiliate or to a successor in connection with a merger, acquisition, or sale of assets, upon notice to you.
